disqualified by RUSADA’s Anti-Doping Disciplinary Commission (DAK) for 12 months, has every reason to retain funding for the disqualification period, believes Sergei Mishin, an attorney who represents him at Lisin, Mishin and Partners.
“The standard disqualification period in this case is four years. It is possible to reduce the sanction to one year only by applying the minor fault of the athlete as a basis, as indicated in paragraph 12.6 and its sub-paragraphs. In Mikhail’s case, this is sub-clause 12.6.1.2 “Contaminated Products”.
Since clause 12.6 is applied in Mikhail’s case, it impacts his status during the period of suspension if we are talking about funding an athlete. The All-Russian Anti-Doping Rules in paragraph 12.14.4 state that disqualified Athletes shall receive a full or partial waiver of Sports Activity Funding or other benefits received by the offending person in connection with Sports Activities in cases where the activity is funded by RUSADA, a federal or regional executive power in the field of physical culture and sports, the All-Russian Sports Federation, professional sports league, National Olympic or Paralympic Committees, directly or through organizations subordinate to them, or otherwise financed from the budget of the Russian Federation, the budgets of the constituent entities of the Russian Federation or local governments.
However, there is an exception that applies to athletes who are subject to the reasons for reduced sanction in paragraphs 12.5 or 12.6, as in the case of Mikhail. These athletes are not subject to the denial of funding requirement. In other words, Mikhail has every reason to stay on the budget preparation for the entire period of the sanction, Mishin told .
