The Court of Arbitration for Sport will not help recover 50 million from the International Football Federation.
The Court of Arbitration for Sport dismissed Donetsk Shakhtar’s claim against FIFA. This is stated on the CAS website. It can be remembered that the Pitmen tried to prove the illegality of the permission of the International Football Federation legionnaires from Ukraine to unilaterally break contracts and take loans to other clubs.
Shakhtar ensured that such a decision led to significant economic losses, backing up the claim with the requirement to recover 50 million euros as compensation from the organization in its favor.
However, two different CAS commissions ruled that the complaint should be dismissed, confirming the legitimacy of FIFA’s decision.
Themis in Lausanne held that the impugned decision followed a legitimate objective in light of the FIFA Statutes and that the measures taken were not manifestly disproportionate and remained within the discretionary power granted to FIFA by Swiss law.
It should be noted that Russian clubs have also applied to FIFA with similar claims. However, their claims were also dismissed along with those filed by Shakhtar.
