Before “Spartacus” Quincy Promes can only be issued in the Netherlands if there are certain legal conditions, while in the case of obtaining Russian citizenship, it will certainly not be available to law enforcement agencies of another country, Igor Bushmanov, managing partner of AB AVEX YUST, football player lawyer Pavel Mamaev, told .
On Monday, we learned that a court in Amsterdam had sentenced Promes to 18 months in prison and compensation of seven thousand euros in the event of an attack on a cousin. The club believe the defense will use the right to appeal the court’s decision. In March, the head of Spartak’s press service, Dmitry Zelenov, told the media that the Russian sports ministry had refused to help the Dutch footballer obtain citizenship due to a dispute.
— Being on the territory of the Russian Federation, Promes can only be issued to the state of the Netherlands if certain legal conditions are met. First of all, it concerns the existence of an international treaty between the Russian Federation and the Netherlands on the extradition of persons accused of committing crimes (extradition), which has not yet been concluded. Second, upon receipt by the Russian Federation of a corresponding request for mutual legal assistance accompanied by a corresponding request for extradition.
The decision to extradite a foreign citizen is the sovereign right of the Russian Federation. Moreover, according to the Constitution of the Russian Federation, a citizen of our country “cannot be expelled from the Russian Federation or extradited to another state.” Thus, if Promes obtains citizenship of the Russian Federation in accordance with the procedure established by law, all the above guarantees will be extended to the latter.
If Promes is put on the international wanted list via Interpol or Europol, the latter will most likely be transferred to serve his sentence in Amsterdam, provided he is outside the Russian Federation. Thus, being on the territory of Russia, Promes is in fact protected from extradition to the law enforcement authorities of the Netherlands, cannot be detained and extradited to another state as a person who has committed a crime.
It should also be noted that UEFA and FIFA cannot influence the contractual (contractual) relationship between K. Promes and FC Spartak Moscow by obliging the club to terminate the contract. This decision is taken exclusively by the club in accordance with the relevant agreement and on its initiative, Bushmanov told a correspondent.
Later, Promes will be tried in the Netherlands in a case of importing drugs through the port of Antwerp.
