CorSport: “Serie B: disputes with Koni, decisive peremptory. Perugia is winning so far. Santopadre…

Postponing the hearing to July 17, the Coni Safeguards Panel yesterday afternoon set out the reasons for the decisions made on the Regina, Perugia, Siena and Foggia appeals. As you know, the highest body of sports justice in Italy confirmed the exclusions of Regina and Siena, adopted by the Federal Council on July 7. On the other hand, the requests of Perugia were accepted, which challenged Lecco’s admission to the Serie B championship, despite the late submission of documentation regarding the infrastructural criteria for the selection of a sports facility, determined in the retreat in Euganeo Padua.

THE CASE OF REGINA. As for Reggina (which changed ownership yesterday), Coni’s judges dismissed all of the arguments put forward by the company, essentially focusing on failure to meet the imperative June 20, 2023 deadline for Covisoc’s obligations. As regards, however, the Reggio di Calabria Court’s request for approval, the vagueness of this provision has been disputed, although disputed by the Revenue Service and INPS. The thesis of the alleged primacy of civil law over sports law was rejected by the Guarantee Board, despite the fact that Saladini’s club provided for the coverage of salaries and deductions in the amount of about 6 million euros. Amaranth managers would have to pay another 700 thousand euros to the Revenue Agency in order to be able to restructure the previous debts inherited from the previous management. The amount that was only transferred to the beneficiaries on July 5th therefore significantly exceeds the June 20th deadline. Therefore, again peremptory becomes decisive.

PERUGIA AND LECCO. This concept was the main reason that led to the acceptance of Perugia’s appeal and the exclusion of Lecco, initially rejected by the technical authorities and later admitted to B by the Federal Council, as the postponement of the play-off final was taken into account close to the dates for the issuance of national licenses. President Tammaro Maiello and rapporteur Guido Ceccinelli confirmed, without the possibility of derogation, that once the conditions for registration for participation in the championship are established, they must be observed.

Daredevil BATTLE. As for Foggia, who was defeated in the Serie C play-off final by Fosca Manzoni’s players, the appeal was declared inadmissible due to “lack of direct and immediate interest in the game”. Recognizing the active legitimacy of President Nicola Canonico, the judges considered that Article 49 Noif excluded any immediate possibility of being admitted to the seat of Lecco, since the relegation rating from Serie B prevails. These are Brescia, Perugia, SPAL and Benevento, which, not by chance, all applied for readmission to the B. stadium. Siena without exit with many default bugs found by Covisoc and confirmed by Coni.

ADMINISTRATIVE TIME. As soon as the reasons are known, companies will be able to apply to Lazio Tar, who will perform on August 2. Hearings in the State Council have already been scheduled for August 29. In the meantime, the Federal Council on July 24 will consider applications for readmission or solace for the next season, but before administrative decisions are made on the definition of the workforce. FIGC has no intention of changing the format. However, it seems inevitable to postpone the start of the two championships, scheduled for 19 and 26 August, and as for B, already with a published calendar, but subject to adjustment.
