The FIG prosecutor’s office appealed to KONI: a petition for the dismissal of Manolo Portanov

Appeal of the Prosecutor General’s Office of the FIG to the KONI Guarantee Council with a request for expulsion Manolo Portanovamidfielder Reggiana, after being sentenced to six years in prison for gang sexual assault. Reporting news is La Gazetta dello Sport on newsstands today. Portanova (23) arrived at the Emilian club, for which he played eight matches, one goal and one assist, according to the formula of an annual loan from Genoa.

Below is the full text of the appeal released by CONI:

The Sports Guarantee Council received the appeal filed by the Office of the Prosecutor General for Sports, represented by the Prosecutor General for Sports, Prefect Hugo Tauser, and the National Prosecutor for Sports, lawyer. Marco Ieradi, towards Mr. Manolo Portanova against decision no. 0039/CFA 2023/24 of the Federal Court of Appeal of the Italian Football Federation of September 15, 2023, RG. 0026/CFA/2023-2024, notification through the PEC on September 21, 2023, according to which, in the disciplinary proceedings registered by the Federal Prosecutor’s Office of the Italian Football Federation under no. 369 pf 22-23 –FIC/2022/0880 against the above-mentioned Mr. Portanova, the complaint filed by the National Sports Prosecutor, acting as Federal Prosecutor, against the decision of the National Federal Court – Disciplinary Section No. was rejected. 0040/TFNSD dated August 11, 2023, by which the above-mentioned trial judge declared his lack of jurisdiction.
The case involves handling note no. Decree No. 902 of June 7, 2023, issued by the National Sports Prosecutor’s Office, imposed liability against the football player Manolo Portanova for violating Art. 4, paragraph 1 CGS, jointly, in accordance with the coordination between the FIG Sports Justice Code and the CONI rules provided for in Art. 3, paragraph 1 of the Civil Code, from Art. 2 and 5, paragraph 1 of the CONI Code of Sportsmanship.
The appellant, the Office of the Attorney General for Sports, requests the Board of Guarantees to declare decision No. invalid, void, and in any event to set aside, revoke or declare it null and void. 0039/CFA 2023/24 dated 15 September 2023, for all the reasons stated in the narrative and in recognition of the acceptance of this appeal:
– in the event of a decision on the merits, acknowledge and confirm its full jurisdiction over the facts involved in the proceedings and declare disciplinary liability against Mr. Manolo Portanova for violation of Art. 4, paragraph 1 of the Code of Sports Justice in combination with articles. 2 and 5, paragraph 1 of the CONI Code of Sportsmanship, imposing on Mr. Manolo Portanova the sanction of a 5-year suspension with presumptive exclusion or such other sanction as the Council shall consider consistent with justice;
– or order the case to be sent to the Federal Court of Appeal in a different composition for a new trial of the case.
