The European Court’s decision regarding the Football Super League indirectly undermines the monopoly of the International Olympic Committee (IOC) in the modern international sports movement, Sergei Alekseev, chairman of the IOC’s sports law commission, told Russian Lawyers Association.
On Thursday, the European Court of Justice ruled that actions by the International Football Federation (FIFA) and the Union of European Football Associations (UEFA) to block the creation of the Super League contravened EU law on competition and the freedom to provide services.
— The European Court’s decision on the Super League, issued against the monopoly of FIFA and UEFA in world football, indirectly deals a blow to the IOC’s monopoly in the modern international sports movement. In particular, the decision indirectly supports the organization of the Friendship Games and other alternative international multi-sport competitions.
The current monopolistic position of the IOC has led to the politicization of international sport, to a violation of the principle of equality of athletes from all countries, to a massive and flagrant violation of the human rights to practice sport, to equal access to participation in competitions, discrimination based on nationality and state affiliation, violation of athletes’ rights to work, citizenship, self-determination and self-identification, causing damage to the property, morality and reputation of athletes and unfair competition in sport. The application of political decisions and sanctions to athletes who have not violated any rule of law. The IOC’s monopolistic position also dilutes the peacebuilding mission of international sport as a means of preventing conflict and uniting people from different countries around the values of sport.
Thus, in accordance with European law and taking into account the judgment of the European Court on the Football Super League, the creation of alternative systems of high-level international sports competitions, in particular the “Games of the Future”, the BRICS Games and the “Friendship Games” are legal, which will prevent massive violations of the rights of athletes, sports organizations and the fundamental principles of international sports law that take place today due to the monopolistic position of the largest organizations international sports. And thus this will contribute to the progressive development of sport at the national and international levels,” Alekseev told the correspondent.
