The Sports Judge, with the assistance of Irene Papi and the representative of the AIA, Mr. Marco Ravaglioli, reviewed the reports drawn up by members of the Federal Prosecutor’s Office and the Field Commissioner regarding the match Ancona – Arezzo on 26.10.2023. and the subsequent procedure for carrying out the preliminary investigation regarding the identification of the sector occupied in home matches by fans of the Arezzo club who were present at the match in question and located in the sector called “Curva Sud”;
– Taking into account the report sent by registered email on 01/11/2024 by the Federal Prosecutor’s Office to this judge in response to the request made, please note the following.
Fans of the Arezzo club, located in the Curva Sud sector, in the 7th minute of the first half launched a powerful firecracker into the playing area, which exploded in the immediate vicinity of a photographer stunned by the explosion and accused of a severe headache and tinnitus.
He considered that the above facts were contrary to the rules of order and security and constituted violent acts committed by his supporters, posing a danger to public safety, and that they were particularly serious because they posed a significant risk to the safety of members and service workers regarding the throwing of firecrackers;
– in this regard, in fact, it should be emphasized that the behavior described above, that is, the release of pyrotechnic materials, led to harmful consequences for the photographer, as stated above;
– after looking through the articles. 6, 13, paragraph 2, 25 and 26 CGS, having assessed the general nature of the facts, it was noted that the sanctioned club played the match away;
– took into account that when grading the sanctions provided for by the totality of the provisions of the articles. 26 and 8 CGS, it is fair to impose a sanction in the form of a fine and the obligation to hold a match with one or more sectors without spectators;
– noted that from the additional report requested by the Federal Prosecutor’s Office, it follows that the fans, among whom were the authors of the behavior in home matches, overwhelmingly (about 70%) occupy Curva. The southern sector, and the remaining part (about 30%) is the side tribune sector;
– considered, therefore, that the identification of industries provided for in Art. 8, letter. d) must be carried out on the basis of this cognitive element, and also on a fair basis, taking into account the total number of away fans present and the predominant occupancy of the Curva Sud sector during home matches by away fans present at the match in question
