The Brazilian player’s trial reached its third day this Wednesday; Daniel Alves is accused of sexual abuse
The judgment of Daniel Alves reached its third day this Wednesday, 7th, in Spain. The Brazilian full-back’s testimony is scheduled for today, in the scheduled last session of the jury chaired by Isabel Delgado Pérezjudge at the Barcelona Court.
The player was arrested on January 20, 2023, accused of sexual abuse against a 23-year-old Spanish girl, in a nightclub in Barcelona. Even with the end of the trial period, there is no deadline for announcing the sentence. Therefore, Daniel Alves must remain in preventive detention until the case is defined.
Witnesses in the case will be heard, and expert data will be analyzed. In this case, the court will evaluate the images from the nightclub’s security cameras in the Spanish city, in addition to the woman’s medical examinations.
The Brazilian will give testimony at the end of this Wednesday’s hearing, after all the hearings. The decision was made after a request from the defense, granted by the judge on the first day of the trial.
What can happen?
The maximum penalty for this type of crime in Spain is 12 years, the time requested by the prosecution. However, the Public Prosecutor’s Office requests nine years of detention.
Daniel Alves, if convicted, could face a maximum of six years in prison. The sentence would be reduced by the defense paying 150 thousand euros (R$800 thousand) to the Court, at the beginning of the process, as compensation to the young woman.
The Public Prosecutor’s Office still wants ten years of supervised release after the period of imprisonment, in addition to the player’s contact with the woman being prohibited for the same period. If acquitted, Daniel Alves will be released immediately.
Attempt at agreement
Daniel Alves received financial help from Neymar Sr., and the defense tried to reach an agreement with the complainant’s lawyers in recent weeks, as reported by the Spanish channel “Telecinco”.
The negotiation was unsuccessful after Lucia Alves, Daniel’s mother, publish the name and image of the complainant on her social networks. The Spaniard’s lawyer stated that she will sue the player’s mother.
