Former player was sentenced to nine years in prison for rape in 2017; Supreme Court of Justice announced that session will be shown on official channel
The trial of the request for approval of the sentence in Italy that sentenced the former striker Robinho will be held next Wednesday, 20th, from 2pm (Brasília time), at the Special Court of the Superior Court of Justice (STJ). The Brazilian was sentenced to nine years in prison for rape.
The Italian court asks that Robinho serve the sentence for the crime in Brazil, since Brazilian legislation does not allow a citizen of the country to be extradited.
The session that will decide the former player’s future will be broadcast live on the STJ’s official YouTube channel and will be open to the press, with space for 36 seats. No cameramen or photographers will be allowed entry. The images will be provided by SCO/STJ.
For the sentence to be approved, a simple majority vote will be required. The STJ Special Court is made up of the 15 ministers with the longest tenure in the House. Thus, the decision requires the vote of eight ministers.
The session will be chaired by the vice-president of the Court, Og Fernandes, and will only vote in the event of a tie. The minister Francisco Falcao will be the rapporteur.
Before the session, lawyers will present their defenses for at least 15 minutes. Next, Minister Francisco Falcão will present his vote as rapporteur, preceding the votes of the other ministers, in order of seniority.
It is worth remembering that this is not a new trial of civil or criminal actions that came from abroad, but an analysis to verify whether the sentence meets the formal requirements set out in article 693 of the Code of Civil Procedure for approval.
Robinho case
Convicted in Italy for participating in a gang rape in 2013, the Brazilian remains in Santos, the city where he lives, and waits for the process to unfold. The conviction came nine years later, ultimately, without the possibility of appeal, but he was not arrested because he was in Brazil.
The player’s defense is moving to prevent the request made by the Italian government, that he serve the sentence he was sentenced to in the European country, from being accepted by Brazilian justice.
The crime took place at the Sio Cafe nightclub, in Milan, on January 22, 2013. The victim was a young Albanian woman, who at the time was celebrating her 23rd birthday. In addition to the former player, five other Brazilians were accused of participating in the rape. However, only the former player and Ricardo Falco were put on trial.
