STJ defines that Robinho must serve time in Brazil; understand

This Wednesday, 20th, Robinho was tried in Supreme Court of Justice to determine whether the former player should serve a sentence in Italy on Brazilian soil. In January 2022, he was sentenced to nine years in prison for rape by Italian justice. Two years later, the Brazilian court ruled that the sentence must be served even outside the European country.

After arguments from all parties involved in the case, with the defense of the former player, represented by the lawyer José Eduardo Rangel De Alckmin. On the other hand, Carlos Nicodemus argued on behalf of Brazilian Union of Womenasking for the approval of the punishment on Brazilian soil.

After discussing the topic, the rapporteur Francisco Falcao started the voting part and took a stand in favor of the former player serving his sentence. In sequence, Raul Araújo took a contrary position, bringing arguments against this attitude of the Brazilian justice system and voted against it. Thus, the score was tied at 1-1.

After the majority was reached, the ministers began the discussion on compliance with the punishment, dealing with the type of regime and the date of Robinho’s imprisonment. Most of the agreement was that the sentence should be served immediately and in a closed regime. The former player’s defense can appeal the decision and ask him to wait for the judgment on his freedom request.
