Candidate of Legal Sciences, lawyer Alexander Karabanov commented on the administrative case against an MMA fighter for Magomed Ismailov.
The Tagansky District Court of Moscow is currently conducting proceedings in the case of an administrative offence under Article 20.3.1 of the Code of Administrative Offenses of the Russian Federation “Incitement to hatred or enmity, as well as humiliation of human dignity”, in which the defendant is Magomed Ismailov. The 38-year-old fighter will appear in court and faces 15 days of arrest.
Earlier, on his social networks, the athlete criticized the actions of the police during special events in one of the places of worship.
— Which quote do you think is most important for the prosecution?
— Let him compare law enforcement officers with bandits. Everything else is at the level of children, but in this case, he has encroached on the system and put the police and bandits on the same level. He is wrong when he talks about law enforcement officers who, as part of their duties, are required to wear masks. In this case, masks are one of the elements that protect employees from reprisals. It is an element of protection of their personality. A bandit and a masked employee are therefore not the same thing. And this must be duly evaluated.
He has crossed the line, there is certainly an administrative law here for incitement to hatred, and for that he must be punished. And if he had not been so careful in his statements, he could have been charged with other articles of the penal code related to incitement to hatred and insults. But I believe that in developing proposals and statements, he feels very well the line so as not to incur criminal liability.
— What will determine the choice between a 15-day arrest or a fine?
— When making a decision, the court considers in which case the measure will be most effective. The purpose of punishment is the correction of the convicted person and the restoration of social justice. At the same time, I can understand this as a believer: according to tradition, one cannot enter a mosque, but we have a secular state, and if the corresponding decree has been issued, then the employees will not take off their shoes. They need speed to organize an event and can also enter an Orthodox church or synagogue. This is not an ostentatious disrespect for Islam, ”Karabaninov told .
