The International Swimming League (ISL) lost its case against World Aquatics in an antitrust lawsuit filed in San Francisco District Court.
ISL is joined in the lawsuit by swimmers Tom Shields, Michael Andrew (USA) and Katinka Hoshsu (Hungary).
– The Court acknowledges that the record is filled with evidence of FINA (formerly World Aquatics) concern over ISL competition. But antitrust laws don’t require a competitor to help another compete against it, the World Aquatics press office cites the court’s ruling.
The Court accepted that the ISL has always been free to organize its own competitions and that World Aquatics, together with its member federations, does not have the power to control the competitions.
“The undeniable proof is that the ISL can and does sponsor high-level swimming competitions without any connection to the member federations. There is no rule (and there never has been) that allows FINA to penalize a swimmer participating in a start not associated with a member federation, and there is no evidence that FINA has ever done or even threatened to do so.
