The club will try to appeal the CAS decision to the Swiss Federal Court and the European Commission
CEO of Shakhtar Sergey Palkin commented the situation with the club lawsuit against FIFA.
“It’s just that in the Court of Arbitration for Sport (CAS) it’s impossible to win against FIFA, there is such a system that technically you will never win. I have made a lot of statements about this situation in Europe, because this needs to be changed. After all, FIFA is above the law.”
“For you to understand. If you are suing in CAS – for example, a football player against a club – three referees are appointed. One side appoints a judge, the other also, and the president is appointed by two judges chosen by the parties. The president has the right to veto everything, he is the chairman of the judiciary.”
“But when FIFA appears as one of the parties to the process, CAS appoints the chief referee. And for you to understand, 80% of CAS income comes from FIFA, they completely control CAS, on the supervisory board of which FIFA representatives sit. Which president do you think they will appoint? Loyal to FIFA.
“That’s why it’s impossible to win. Therefore, we are now going to the Swiss Federal Court, to the European Commission. And we will go to the end, because what they did is just stealing from Ukrainian clubs. And this is not a tolerant position during the war. When the whole civilized world supports us, and such a well-known organization drowns us.”
“Moreover, they don’t get in touch, they don’t help in any way. Okay, you’re picking up football players here, but deal with the debts then. Go to the clubs we owe, talk to them, cancel the debt. FIFA has chosen a policy of complete disregard for Ukrainian clubs and Ukrainian football.”
“Next week we are filing with the European Commission because FIFA violated European antitrust laws in full with this decision. And when we get the full CAS decision, the entire text will be filed with the Federal Court. But not all cases are accepted there. But this judiciary, created in CAS, does not allow this case to be won at all. So we’re going to change the system.”
“You see, FIFA is a body that stands above states. It is unrealistic to reach out there so that they make a normal decision. But we want the world to know what they did to Ukrainian clubs.”
Recall that the Pitmen appealed to the international authority because of FIFA’s decision to allow foreign players to suspend contracts with Ukrainian clubs until the summer of 2023 in connection with the full-scale invasion of Russian troops into the territory of Ukraine. The miner demanded to cancel the decision of FIFA. The Donetsk club also planned to oblige the International Football Federation to pay damages in the amount of 50 million euros.
CAS dismissed the appeal and determined that FIFA did not violate the law in its decision regarding the Ukrainian club. The miner is appealing the CAS decision to the Swiss Federal Court and the European Commission.
