CAS backs FTA’s call to bar Russians from participating in international federation governing body elections

The Court of Arbitration for Sport (CAS) has upheld the appeals of the head of the Russian Weightlifting Federation (FTAR) Maxim Agapitov, Alexander Kishkin and Dmitry Chernogorov against the decision of the special commission on the admission of the International Weightlifting Federation (EDP IWF) to ban the nomination of candidates to IWF governing bodies, according to the CAS website.

The IWF had previously decided to ban Russian candidates from running in the elections. Agapitov applied for several positions, including the position of head of the organization. Kishkin and Chernogorov ran for various IWF committees. The Russian side appealed the decision to the CAS. The Independent Admission Commission (EDP) announced in May that Russian representatives could not participate in the elections.

– The CAS panel that dealt with this matter concluded that the EDP does not have the power to prohibit the FTA from nominating candidates for election. Indeed, such a decision is of a disciplinary nature and, as stated in Article 13 of the IWF Statutes, the EDP is not empowered to take a decision regarding the suspension of the FTA in the light of the Article 13.12 of the IWF Constitution. Thus, the college of arbitrators of the CAS could only reverse the contested decisions and declare that the reason justifying the impossibility of admitting the candidates Agapitov, Chernogorov and Kishkin proposed by the RWF for the elections no longer exists, indicates The report.
