“Dear Stanislav Vladimirovich!
In connection with our receipt of the notification of the preparation of a new meeting of the Disciplinary Commission of the VFV regarding the sanctions previously imposed on the player of the women’s volleyball club “Dynamo” (Moscow) Goncharova NO, we ask you to personally monitor the respect of the members of the disciplinary commission in the context of your work in accordance with the regulations of the VFW and the regulations of the disciplinary commission. Namely: when placing an issue on the agenda, following the procedure for considering the issue, thoroughly studying the grounds for imposing sanctions and making a decision on sanctions, apply exclusively the sanctions provided for by the VFW Regulations.
Our appeal is due to the fact that during the first consideration of the issue regarding Goncharova NO At the commission meeting on May 15, 2024, during the preparation and consideration of the issue, determining the responsibility of the player and choosing the sanction, these provisions were grossly violated.
It would not be an exaggeration to say that the Disciplinary Commission actually violated the general principles of legal responsibility determined by the Constitutional Court of the Russian Federation, which include fairness, proportionality and legality (Decision of the Constitutional Court of the Russian Federation). We attach to our appeal a legal opinion in which an independent law firm analyzed the legality and validity of the decision of the VFW Disciplinary Commission of May 15, 2024 regarding the sanction of NO Goncharova.
If we briefly summarize the results of the legal analysis, we can state the following.
— The minutes of the committee meeting do not specify on what basis this question was examined. There is still no information on who (or if) contacted the disciplinary commission about this. None of the persons authorized to do so and listed in clause 3.2. The commission’s regulations are not specified in the protocol.
— Goncharova NO was deprived of the opportunity to provide an explanation regarding the controversial situation of unsportsmanlike behavior, which violated the fundamental principle of fairness when it comes to holding a person accountable.
— Applied to Goncharova NO the disciplinary sanctions do not correspond to the seriousness of the offense committed and do not take into account the previous and subsequent behavior of the athlete.
— Removal of Goncharova NO from a match of the Russian Volleyball Championship of the 2025 season, the Disciplinary Commission violated Article 93 of the VFV Regulations, since, on the one hand, the Regulations do not provide for the possibility of suspension for the following season and, on the other hand, according to article 93.1 of the Regulations, a sanction in the form of suspension of participation in a match, which comes into force from the following match and not in a specific competition, for example the 2025 Russian Championship, but in all competitions organized by the VFW.
— This legal opinion reveals several other actions of the Disciplinary Commission that contradict the provisions of the disciplinary section of the VFW Regulations (Part VIII) and the Regulations of the Disciplinary Commission, approved by the Presidium of the VFW on January 25, 2013 (Protocol N2) and signed by you. Explanations are also given on the legal procedure for the subsequent resolution of this dispute.
