Olympic champion Dyachenko intends through the Moscow City Court to invalidate the disqualification on the territory of the Russian Federation

Russian Kayaking Olympic Champion Alexander Diachenko o reported that he filed a lawsuit in the Moscow City Court to have the Court of Arbitration for Sport (CAS) decision on the disqualification recognized as invalid in the Russian Federation.

In June, CAS upheld an appeal by the World Anti-Doping Agency (WADA) against the International Canoe Federation (ICF) decision and suspended Dyachenko for four years for using banned substances. An athlete’s disqualification period is counted from June 9, 2022.

– I filed a lawsuit in the Moscow City Court to cancel the disqualification on the territory of Russia, that is, to declare the CAS decision invalid on the territory of Russia. The court will consider my request at the end of August. The CAS decision is politicized, it is based on the allegations of certain people which are not supported by any evidence. But for some reason CAS found WADA’s arguments compelling. The International Canoe Federation (ICF), in turn, said it did not want to understand the matter. In general, Russian sports are now crushed on all sites, which is very disappointing.

– Was it possible to challenge the CAS decision before the Federal Court of Switzerland?

— It’s a very complicated process, there are a lot of pitfalls, and it’s expensive. As far as I know, the Swiss Federal Court does not have the power to overrule the CAS decision. He can only compel the CAS to reconsider the case if the CAS has committed serious irregularities in the handling of the case. But the CAS itself conducted the procedure correctly from a legal point of view. It is in the sporting aspect of such cases that the Swiss Federal Court does not interfere,” Dyachenko told .
