If I received a traffic ticket far from home: can I pay a traffic fine from another municipality in my own city?

As expected, this long national holiday weekend was marked by heavy traffic throughout the country. 501,198 vehicles left the capital alone, or 1.7% more than in 2022, with Route 5 South being the busiest, followed by Route 68.

However, there is a legal form for these cases, in which it is not necessary to apply to the local police court of the municipality in which the offense was committed, but you can request a fine order. Do you know what it is? And how does the procedure take place?

According to Law No. 18,287 which establishes the procedures before the Local Police Courts (JPL), an arrest warrant corresponds to a legal procedure which takes place when a person has been issued with a traffic fine in a municipality far from their place of residence .

These people will receive a summons within a period which varies between 10 and 20 working days after the occurrence of the event, depending on the regulations in force.

Through the warrant, it is requested that the retained license be returned and that the convicted person can comply with legal actions in their municipality of residence and thus not have to go to the municipality where the offense took place.

In the event that the fine was issued in a municipality in the Metropolitan Region, the driver will not be able to request the establishment of a warrant if he resides in another municipality in the same region. That is to say, you must go to the local police court in the municipality where you committed the offense.

Exceptionally, you can request the warrant if the report comes from the municipalities of Lampa or Tiltil.

What do I need to perform the procedure?

To request processing of the mandate, the interested person must present:

  • Valid ID card.
  • Citation coupon issued by the Carabineros of Chile.
  • Receipt for payment of the fine (in the name of the holder).
  • Affidavit of address signed before a notary, or residence document issued by the neighborhood association concerned, for the purposes of proving domicile.

How and where should I do the procedure?

Important :

  • It must be presented at least two days before the summons date indicated on the report ticket.
  • Once the warrant has been requested, the judge of the locality where the offense arose will communicate the sentence to his colleague who processed the request. In addition, he will send the retained permit, which will be returned upon payment of the fine.
  • The judge of the place of residence will keep the ticket and grant the person a provisional driving license (for a maximum period of 30 days), provided that the offense does not concern driving with or without an expired license.

What is the cost of the procedure?

The exhortation has no cost. The person will have to pay the fine imposed by the local police court concerned.
